Terms of Service

Welcome to OSINT Trace. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "User," or "You") and OSINT Trace ("we," "our," or "us"), governing your access to and use of osinttrace.com, the customer portal at app.osinttrace.com, our REST API services, and associated digital intelligence software (collectively, the "Services").


1. Agreement to Terms

By creating an account, generating an API key, purchasing a subscription, or accessing any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to all terms, you must immediately cease all access and use of the Services.

2. Description of Services & Digital Delivery

OSINT Trace provides software-as-a-service (SaaS) and developer API endpoints for automated digital footprint analysis, public online identity verification, brand protection, and threat intelligence research. All services and digital licenses are delivered electronically via cloud dashboard access and API tokens immediately upon purchase and verification.

3. Merchant of Record & Billing (Paddle.com)

Our order process, payment processing, tax compliance, and subscription invoicing are conducted by our online reseller and Merchant of Record, Paddle.com Inc. / Paddle Payments Ltd. ("Paddle").

  • Recurring Subscriptions: Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless canceled prior to the renewal date.
  • Invoices & Taxes: Paddle calculates and collects applicable sales tax, VAT, and GST based on your billing jurisdiction.
  • Buyer Support: Transaction receipts, invoice history, and billing inquiries can be accessed through Paddle.net.

4. Account Security & API Keys

You are solely responsible for maintaining the confidentiality of your account credentials and API tokens. Any action or API call initiated under your credentials will be deemed executed by you. You agree to notify us immediately at [email protected] of any unauthorized access or security breach.

5. Permitted & Acceptable Use Policy

You agree to use OSINT Trace exclusively for ethical, legitimate, and lawful purposes (e.g., cybersecurity threat hunting, brand protection, fraud detection, trust & safety investigations, and compliance checks). You expressly warrant and agree that you will NOT:

  • Use the Services for unlawful stalking, harassment, physical surveillance, doxxing, or intimidation of any person.
  • Attempt to bypass authentication barriers, access private or password-protected accounts, or breach computer fraud and security laws (such as the CFAA).
  • Use data obtained from the Services for credit eligibility, employment screening, housing decisions, insurance underwriting, or any purpose regulated under the Fair Credit Reporting Act (FCRA) or similar national consumer reporting laws.
  • Resell, redistribute, or sub-license our raw API keys or database queries to third parties without prior written authorization.

6. Fair Usage, Quotas & Rate Limits

Each subscription and API tier includes defined query quotas and rate limits (requests per second/minute). We reserve the right to throttle, suspend, or terminate accounts engaging in abusive automated scraping, DDoS attacks, or activities intended to destabilize our infrastructure.

7. Cancellation & Refund Policy

Subscriptions may be canceled at any time directly through your account dashboard or via Paddle.net. Cancellations take effect at the conclusion of your active paid billing cycle. Refund eligibility and statutory cancellation terms are detailed in our Refund Policy.

8. Intellectual Property

All software code, UI designs, trademarks, API schemas, documentation, and algorithms comprising OSINT Trace are the proprietary intellectual property of OSINT Trace and its licensors. You receive a non-exclusive, non-transferable, revocable license to access the Services for the duration of your active subscription.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. OSINT TRACE DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Because OSINT Trace queries publicly available information across independent third-party platforms, we do not warrant that results will be uninterrupted, 100% complete, error-free, or that third-party platforms will remain permanently accessible or compatible.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL OSINT TRACE, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS REPUTATION) ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO OSINT TRACE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

11. Indemnification

You agree to defend, indemnify, and hold harmless OSINT Trace and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your violation of these Terms, your misuse of the Services, or your violation of third-party rights or applicable laws.

12. Modifications to Terms

We may update or revise these Terms from time to time. If revisions are material, we will post notice on our site or notify you via email. Continued use of the Services following updates constitutes your acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of our operating jurisdiction, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved in the competent courts of that jurisdiction.
